terms of service

These are the terms for using Elonslist (elonslist.org), operated by Heirlane LLC ("Elonslist", "we"). By using the site you agree to them. They're written to be read, not skimmed past - the short version of each section is its first sentence.

1. What Elonslist is - and isn't

Elonslist is a venue where sellers list Tesla vehicles and buyers find them. We are not a party to any vehicle sale. We never take custody of vehicles, titles, or sale funds; we don't process vehicle payments, provide escrow, or transfer ownership. The transaction - negotiation, payment, paperwork, delivery - happens directly between buyer and seller, and its risks are theirs.

2. Accounts

Sign-in is by emailed magic link. You're responsible for what happens through your email-verified session. You must be 18+ and able to form a contract. We can suspend accounts that break these terms or the law.

3. Listings

• List only a vehicle you own or are authorized to sell.
• Everything you state must be accurate to your knowledge - mileage, title status, options, accident history. Misrepresentation is grounds for removal and account termination.
• If you are a licensed dealer, you must disclose it during listing. Most states require license disclosure in vehicle advertising.
• Listings run 60 days, renewable free. New listings may be held briefly for review. We may decline or remove any listing (fraud signals, policy violations, legal reasons).
• You keep ownership of your listing content and photos, and grant us a license to display and distribute them for operating and promoting the marketplace.

4. PulseCheck Verified Listing

The PulseCheck Verified Listing ($19, one-time, per listing) is a digital service: you authorize a one-time reading of your own vehicle through Tesla's official API, and we publish the results on your listing with a verified badge. Payment buys the right to run the verification - the badge appears when the reading succeeds. Two successful readings are included per purchase. If verification cannot produce a report at all, contact us for a full refund. The verified badge reflects what the vehicle reported at reading time; it is not a mechanical inspection, a history report, or a guarantee of condition. A refunded purchase removes the badge.

5. Verification data and reports

PulseCheck reports and all listing information are provided for informational purposes only. Always verify details with the seller before purchase. Vehicles change after a reading - mileage accrues, condition evolves. Do the inspection, check the paperwork.

6. Dealer subscriptions

Dealer plans bill monthly through Stripe, cancel anytime from the billing portal, no long-term contract. Plan limits (listing caps, feed access) are enforced by the plan. Founding-dealer arrangements are honored per their stated terms. We may change plan pricing with notice; changes apply from your next billing cycle.

7. Messaging and conduct

Messaging exists to discuss listings. No harassment, spam, off-platform payment scams, or soliciting for anything other than the listing at hand. Automated screening flags scam-pattern messages for review. You can block users; we can remove accounts.

8. Prohibited uses

• Fraudulent listings, misrepresented vehicles, VINs you don't control
• Scraping or bulk-collecting user data
• Circumventing fees, caps, or verification
• Anything illegal under applicable law

9. Disclaimers and liability

The service is provided "as is". To the maximum extent allowed by law, we disclaim implied warranties and are not liable for the conduct of buyers or sellers, the condition of any vehicle, or indirect and consequential damages. Our total liability for any claim is capped at the greater of $100 or the fees you paid us in the twelve months before the claim. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

10. Trademarks

Elonslist is an independent marketplace and is not affiliated with, endorsed by, or sponsored by Elon Musk or Tesla, Inc. Tesla and its model names are trademarks of Tesla, Inc., used only to identify the vehicles listed.

11. Governing law and changes

These terms are governed by the laws of the State of California. If we change these terms materially, we'll update the effective date and note it plainly; continued use after a change is acceptance. Questions: hello@elonslist.org. See also our Privacy Policy.
